Terms & Conditions

By downloading, accessing, registering for, or using PasPas, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms.

2.1 Platform only

PasPas is a technology marketplace / matching platform that enables:

• Travelers / transporters to publish routes or availability
• Senders to publish package needs or find travelers
• Users to discover potential matches, communicate in-app, and coordinate arrangements

2.2 We are not a carrier or party to your delivery

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PasPas is not a courier, logistics company, transporter, freight forwarder, postal service, warehouse, insurer, escrow agent, bank, or employer of Users.
• PasPas does not take possession, custody, or control of packages.
• PasPas does not own, operate, or inspect Users’ vehicles.
• Any arrangement to carry a package is a private agreement solely between the Users involved.
• PasPas is not a party to contracts between Users and is not responsible for performance, non-performance, delay, damage, loss, theft, fraud, injury, or disputes arising from User-to-User interactions.

2.3 No guarantee of matches or outcomes

We do not guarantee that:

• You will find a match, booking, or traveler
• Any listing is accurate, available, legal, or safe
• Any User is trustworthy, licensed, insured, or who they claim to be
• Any delivery will be completed, on time, or at all
• Prices, routes, or availability will remain unchanged

You must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have legal capacity to enter binding contracts
• Provide accurate registration information
• Use the Service only for lawful purposes

If you use PasPas on behalf of a business, you represent you have authority to bind that business to these Terms.

You agree to:

• Provide true, current, and complete information
• Keep your credentials confidential
• Promptly update profile and contact details
• Accept responsibility for all activity under your account

We may refuse registration, suspend, or terminate accounts at our discretion for suspected fraud, abuse, legal risk, or Terms violations.

OTP / verification: Email OTP or other verification steps are for account security. Successful verification does not mean we endorse your identity to other Users beyond facilitating the Service.

5.1 General

You agree not to:

• Violate any law or third-party rights
• Harass, threaten, defraud, or exploit other Users
• Impersonate any person or misrepresent affiliation
• Scrape, reverse engineer, or interfere with the Service
• Upload malware or attempt unauthorized access
• Use the Service for money laundering, trafficking, or other illegal activity
• Post false, misleading, or spam listings
• Circumvent safety, payment, or communication features in bad faith where provided

5.2 Prohibited packages / goods

You must not list, send, carry, or arrange carriage of items that are illegal or restricted under applicable law, including without limitation:

• Illegal drugs, narcotics, or controlled substances
• Weapons, explosives, ammunition, or hazardous materials without lawful authorization
• Stolen property
• Counterfeit goods
• Human trafficking-related items or persons (PasPas is not for transporting people as passengers under a “package” listing)
• Items banned by airline/rail/road carriers or local regulations for the chosen mode of travel
• Perishable, hazardous, or high-risk items unless both Users knowingly and lawfully agree and comply with all laws

You are solely responsible for confirming that any package is legal to possess, transport, and deliver on the intended route and mode of transport.

5.3 Traveler / transporter responsibilities

If you offer to carry packages, you alone are responsible for:

• Your vehicle fitness, licenses, permits, and insurance (if any)
• Compliance with traffic, transport, and safety laws
• Deciding whether to accept a package
• Safe handling and custody once you take possession
• Any damage, loss, delay, or third-party claims arising from your carriage

5.4 Sender responsibilities

If you send packages, you alone are responsible for:

• Accurate description of contents, size, weight, and value
• Proper packing
• Lawful contents
• Providing correct pickup/drop details and contacts
• Any customs, tax, or regulatory obligations
• Insurance for high-value items (PasPas does not insure packages)

• Listings and chats are User-generated. We do not pre-approve all content.
• We may remove content or restrict accounts that violate these Terms or create risk.
• In-app chat is provided for coordination. Sharing personal contact details is at your own risk.
• Phone calls or offline meetings arranged via the App are undertaken at your sole risk.

We are not responsible for misunderstandings, no-shows, cancellations, price disputes, or failed handovers between Users.

Unless expressly stated otherwise in the App:

• Any payment for carriage is arranged directly between Users
• PasPas may introduce platform fees, premium features, or paid memberships in the future; additional terms will apply
• You are responsible for taxes applicable to your transactions

PasPas is not responsible for unpaid amounts, chargebacks, cash disputes, or fraudulent payment claims between Users.

Meeting strangers and exchanging packages involves inherent risks, including theft, assault, fraud, accidents, and property damage.

You agree that:

• You use PasPas and meet other Users at your own risk
• You should take reasonable safety precautions (meet in public places, verify identity as best you can, do not share unnecessary personal data, trust your judgment)
• PasPas does not conduct comprehensive background checks on all Users (unless a specific verified feature is expressly labeled as such)
• Any “rating”, profile info, or chat history is informational only and not a safety guarantee

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• RESULTS WILL BE ACCURATE OR RELIABLE
• DEFECTS WILL BE CORRECTED
• THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS
• ANY USER, LISTING, OR PACKAGE ARRANGEMENT WILL MEET YOUR EXPECTATIONS

Some jurisdictions do not allow certain disclaimer exclusions; in those cases, disclaimers apply to the fullest extent permitted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASPAS AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY
• PERSONAL INJURY OR PROPERTY DAMAGE
• LOSS, THEFT, DAMAGE, DELAY, OR MISDELIVERY OF PACKAGES
• ACTS OR OMISSIONS OF ANY USER OR THIRD PARTY
• UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR COMMUNICATIONS
• FAILURE TO MATCH USERS OR COMPLETE ANY TRANSACTION

ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CAP: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO PASPAS (IF ANY) FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR (B) INR 1,000 (or equivalent).

Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, certain liability for fraud or death/personal injury caused by proven negligence, where such exclusion is prohibited).

You agree to defend, indemnify, and hold harmless PasPas and its owners, directors, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your listings, packages, travel, or carriage activities
• Your breach of these Terms or applicable law
• Your infringement of third-party rights
• Disputes between you and another User
• Any content you submit

If you have a dispute with another User, you release PasPas from claims, demands, and damages of every kind arising out of such dispute, to the maximum extent permitted by law. We may, but are not obligated to, help facilitate communication or remove content; any involvement does not create liability or make us a party to your dispute.

The PasPas name, logos, App design, software, and content (excluding User content) are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful use as permitted by these Terms.

You retain ownership of content you submit, but grant us a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify (for formatting), display, and distribute that content as needed to operate and improve the Service.

Maps, notifications, analytics, hosting, and app-store services are provided by third parties. Your use of those services may be subject to additional terms. We are not responsible for third-party outages, errors, or policies.

We may suspend or terminate access immediately, with or without notice, if we believe you violated these Terms, create risk, or for operational/legal reasons. You may stop using the Service and request account deletion as described in the App or Privacy Policy.

Provisions that by nature should survive (disclaimers, limitations, indemnity, governing law, etc.) survive termination.

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet/power failures, government actions, epidemics, or third-party service failures.

These Terms are governed by the laws of India, without regard to conflict-of-law rules.

Informal resolution first: Contact support@paspaspackage.in and attempt to resolve disputes informally within 30 days.

Jurisdiction: Subject to applicable law, exclusive jurisdiction lies with the competent courts in Chandigarh, India.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to the maximum extent permitted by law.

• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability: If any provision is unenforceable, the remainder stays in effect.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• No agency: No joint venture, partnership, employment, or agency relationship is created between you and PasPas, or between Users, solely by using the Service.
• Language: English controls if translations conflict.

For clarity (this summary does not replace the full Terms):

1. PasPas connects people; it does not deliver packages itself.
2. Arrangements are between Users; PasPas is not responsible for loss, damage, delay, fraud, or injury related to deliveries or meetings.
3. You are responsible for legality of contents, compliance with transport laws, and your own safety.
4. The Service is provided as-is; liability is limited as set out above.
5. You indemnify PasPas against claims arising from your use and User disputes.
